Terms of Service

1. Acceptance of terms

By accessing or using Gatherfam at gatherfam.app ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Gatherfam is operated by Rhetorical Trope, LLC.

2. Description of service

Gatherfam is a family-first event invitation platform that allows hosts to create events, invite families, track RSVPs, and coordinate food. The Service includes a web application, email notifications, and SMS messaging. Gatherfam is offered as a free tier and as an optional paid subscription tier ("Plus"), described in our Pricing page.

3. Accounts

To create events and manage invitations, you must create an account using a valid email address. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 18 years old to create an account.

Guests do not need an account to respond to invitations.

4. Subscriptions and billing

The Gatherfam Plus subscription is offered on a recurring monthly or annual basis at the prices listed on our Pricing page. Payments are processed by Stripe, Inc. We do not collect, see, or store your full payment card details — only the billing metadata Stripe returns to us (card brand, last four digits, expiration month and year).

Automatic renewal. Your subscription renews automatically at the end of each billing period using the payment method on file, until you cancel. By subscribing, you authorize Rhetorical Trope, LLC to charge your payment method on each renewal.

Price changes. If we change the price of a subscription tier, current subscribers will remain on their original price for at least twelve (12) months from the date of the change. We will notify you by email at least thirty (30) days before any price change affects your account. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

Failed payments. If a payment fails, we will retry the charge over approximately two weeks via Stripe's standard retry schedule. You retain access to Plus features during this period and will see an in-app banner prompting you to update your payment method. If all retries fail, your subscription will be cancelled and your account will revert to the Free tier.

5. Cancellations and refunds

Cancellation. You may cancel your Plus subscription at any time from your account's billing settings. Cancellation takes effect at the end of your current billing period — you will retain access to Plus features through that date, and your card will not be charged again. Your data (events, families, groups, messages) is preserved if you resubscribe later.

Refund policy. Because cancellation is effective at period end, subscription fees are generally non-refundable once a billing period has begun. However, we will issue a refund in the following circumstances:

• You were charged due to a bug, a duplicate charge, or a technical error on our side
• You were charged for a renewal within 14 days of requesting cancellation and demonstrably did not use Plus features during that period
• You accidentally subscribed and contact us within 14 days of the charge

To request a refund, email support@gatherfam.app with your account email and the approximate charge date. Approved refunds are issued to the original payment method within 5–10 business days.

Chargebacks. Before initiating a chargeback with your card issuer, please contact us at support@gatherfam.app — we can almost always resolve billing issues directly and faster than a chargeback process.

6. Acceptable use

You agree not to use the Service to:

• Send unsolicited messages or spam
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Upload or transmit malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or its systems
• Use the Service for any unlawful purpose
• Scrape, crawl, or collect data from the Service by automated means

We reserve the right to suspend or terminate accounts that violate these terms.

7. SMS and email messaging

By providing a phone number or email address (either as a host or as a guest whose information is provided by a host), you consent to receive transactional messages related to events you are involved in. These include invitations, RSVP confirmations, event updates, and reminders.

You can opt out of SMS messages at any time by replying STOP. Standard message and data rates may apply. Message frequency varies based on event activity. See our Privacy Policy for details on how we handle your information.

8. Host responsibilities

As a host, you are responsible for ensuring you have permission to share the contact information (email addresses, phone numbers) of the families you invite. You agree to only invite people who have a reasonable expectation of receiving an invitation from you.

9. Content

You retain ownership of any content you submit to the Service (event descriptions, names, messages, images). By submitting content, you grant Gatherfam a limited license to store, display, and transmit that content as necessary to operate the Service.

We do not monitor user content proactively but may remove content that violates these terms or applicable law.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share your information.

11. Service availability and changes

We strive to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of material changes.

12. Limitation of liability

The Service is provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Gatherfam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater.

13. Termination

You may delete your account at any time. We may suspend or terminate your access to the Service if you violate these terms or if we discontinue the Service. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive (such as limitations of liability) will remain in effect.

14. Changes to these terms

We may update these terms from time to time. We will notify active users of material changes via email. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.

15. Governing law

These terms are governed by the laws of the United States. Any disputes shall be resolved in a court of competent jurisdiction.
